I think you should call an ebay CS and ask them how you can appeal/dispute the "not as described" case because as it stands now not only will you have to pay return shipping but ebay is going to hit you with a defect. ... You lose eBay buyer protection if you refuse it. So possibility of no refund (and no item). Do the proper thing and take delivery of the item, and maybe you can return. Or sell it yourself on eBay. EBay isn't the best place to buy time-sensitive items.
