    Safe Delivery. Safe Delivery is a law which allows a parent or parents to safely and legally surrender their newborn, no more than 3 days old. A newborn may be given to a uniformed employee who is inside and on duty at any hospital, fire department, police station, or by calling 9-1-1.

    Senate Bill 1052 added the "Safe Delivery of Newborns Law" (Chapter XII) to the Probate Code and amended the juvenile code (Chapter XIIA of the Probate Code) to govern parental surrender of a "newborn" to an "emergency service provider". ("Newborn" means a child whom a physician reasonably believes to be not more than 72 hours old.
